Legal Intellectuals in Modern China’s Codification Process

A Focus on the Second Civil Code Revision

This lecture examines the processes and objectives of legal codification in modern China, which underwent three phases: the Late Qing Legal Reform (1908-1911), the Beiyang Government’s Draft Legislation (1923–1926), and the Nanjing Government’s Legislation (1928–1931). Each phase had its unique background and objectives, and all included efforts to draft civil codes. The lecture will explore the key legal scholars who participated in the 1924 Civil Code Draft revision process and their distinctive characteristics. It will conclude by analysing the implications of the revised Second Civil Code Draft
